1. Agreement to Terms

Welcome to Relishd. These Terms of Service ("Terms") govern your access to and use of the Relishd mobile application and related services (collectively, the "Service"). The Service is operated by an individual in the United States ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Relishd is a mobile application that allows users to:

  • Discover and search for dishes and restaurants
  • Create and share reviews with ratings and photos
  • Follow other users and see their reviews
  • Create and share curated lists of dishes and restaurants
  • Build a personal food journal

The Service relies on user-generated content and third-party data sources. We do not guarantee the accuracy, completeness, or reliability of any information displayed.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

The Service is currently available in the United States. By using the Service, you represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country.

4. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Not share your account or password with others
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

You may sign up using your email address or through third-party authentication providers (Google or Apple). We reserve the right to refuse registration or cancel accounts at our discretion.

5. User Content

5.1 Your Content

You retain ownership of content you create and post on the Service, including reviews, photos, lists, and comments ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform your User Content in connection with operating and promoting the Service.

This license continues even if you stop using the Service, but only for User Content that has been shared with other users or made public. If you delete your account, we will remove your User Content within 30 days, except where it has been shared or saved by other users.

5.2 Content Guidelines

You agree not to post User Content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
  • Contains hate speech, discrimination, or promotes violence against any group
  • Is sexually explicit, pornographic, or obscene
  • Infringes on any patent, trademark, copyright, or other intellectual property rights
  • Contains spam, advertising, solicitations, or commercial content
  • Is intentionally false, misleading, or fraudulent
  • Contains personal information of others without their consent
  • Impersonates any person or entity
  • Contains malware, viruses, or other harmful code

We reserve the right to remove any User Content that violates these guidelines or that we find objectionable, without prior notice. Repeated violations may result in account suspension or termination.

5.3 Content Accuracy

You are solely responsible for the accuracy of the User Content you post. Reviews should reflect your genuine personal experience. Fake reviews, paid reviews (unless clearly disclosed), or reviews of places you have not visited are prohibited.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use any automated system, bot, scraper, or similar technology to access the Service without our written permission
  • Collect or harvest user information without consent
  • Create multiple accounts to evade restrictions or bans
  • Harass, bully, or intimidate other users
  • Attempt to manipulate ratings or reviews
  • Use the Service to send unsolicited communications
  • Reverse engineer, decompile, or disassemble any part of the Service

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you agree to our Privacy Policy.

You can control certain privacy settings within the app, including setting your profile to private, which requires your approval before others can follow you and view your content.

8. Intellectual Property

The Service, including its original content (excluding User Content), features, and functionality, is owned by us and is protected by copyright, trademark, and other intellectual property laws.

The Relishd name, logo, and related branding are our trademarks. You may not use these without our prior written permission.

All other trademarks, service marks, and logos used in the Service are the property of their respective owners.

9. Third-Party Services

The Service integrates with and relies on third-party services, including:

  • Google Places API: For restaurant and location information
  • Google and Apple Sign-In: For account authentication
  • Cloudinary: For image storage and processing

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant or guarantee:

  • The accuracy, completeness, or reliability of any User Content or reviews
  • The quality, safety, legality, or availability of any restaurants or dishes
  • That the Service will be uninterrupted, secure, or error-free
  • That the Service will meet your specific requirements
  • That any information obtained through the Service will be accurate or reliable

You use the Service at your own risk. Any reliance on User Content, reviews, or other information is at your sole discretion and risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend, and hold harmless Relishd and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

13. Account Termination

You may delete your account at any time through the app settings. Upon deletion, your account and associated personal data will be removed within 30 days, as described in our Privacy Policy.

We may suspend or terminate your account at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms within the app or by other reasonable means prior to the changes taking effect.

Your continued use of the Service after any changes indicates your acceptance of the new Terms. If you do not agree to the modified Terms, you should stop using the Service and delete your account.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of such courts.

16. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
